    It's most interesting that Mexico EB3 moved past the 2001 Apr30/May01 barrier. So the theory that fired Java/HTML H1's from the dotcom era bring up the 245(i) does seem to hold water.

    I dont know what to say about EB2 India.

    I am in a similar situation getting married in Sep07 and returning with my wife at end of Sep'07. It is little scary, as some say it might be risky not to apply along with the spouse.

    Should I go ahead and apply for I485, EAD and AP all three at the same time now, or to apply just for I485?

    I am not sure what advantage would be applying now, as I have to wait until the dates become current again, and I will not be able to use my EAD to maintain my wife's H-4 status.

    None of the Amitabh Bachans did any thing for slums,Danny Boyle Made a very good movie.I think the fact is Rehman is a prodigy no doubt about that, he makes very good music we all know that.As compared to Hollywood directors Bollywood directors are subpar with the exception of very few good ones. Movie business is controlled in India by few families,what ever the movies they make rest of the people will watch it.I dont want to open the bollywood can of worms.Movie directors in India are usually sons of Bollywood actors or some one related to Bollywood.

    I am sure none of the Bollywood directors would ever be able to make good movies,they dont have a global outlook,neither the needed juice. usually Bollywood directors are some low key high school drop outs who have connections with mafia.

    If some one who is reallly talented is not going to make it in Bollywood,Southern Film industry is even worse.

    Didn't do that(For my own personal reasons). Hoping for having enough time (1 day or two max) before my PD gets current and I send in my future wife's AOS on the first day they become current. If it gets approved, I am screwed and she has to have her own GC processing.



    Also, send your application just before Aug 17th (say 15th).

    I couldn't wait, because I have to attend my sister's marriage on Sep5th, so, now, I am waiting for the receipt. I am in such a bind, looks like I aged two years in 15 days :) .

    Guess What from NOV - 08 to July 09, the VB will have older Cut off dates and after July 09 DOS will open the flood gate and move the cutoff of to 2007 or even 2008.

    USCIS will start approve the cases with later PD's and the leave the older PD's on the air.

    It is a mess. I don't have any trust in USCIS

    There are 3 work categories,
    at least 3 queues each for three stages.
    the first queue had at one time, rir, regular and then bec, perm added to the mix.
    EB portings.
    07/07 havoc
    name check delays.

    a single queue at the end.

    bottomline, PD monthly graph is arbitrary.
    if your PD remains current for at least three months in a row and everything else is clear, there is good chance you are out of the pipeline.

    Welcome back, the only way we can see progress is by getting some bills passed. Lets all work towards getting something done with the logfren bills.

    Guys,
    I think all of us EB2 ( including yours truly) are guilty of too much analysis paralysis of EB2 visa no.s for the remainfer of FY 08. With today's post by a lawyer on DOS communication to USCIS to stop allocating visa numbers to India/China till OCT 1 , 08, it is clear that USCIS will never get its act straight unless we are completely united and press on for a major drive to senators to pass the visa recapture bill ( regardless of EB2 and EB3) . So let us start flooding the senators inbox, voicemail and email with letters urging them to pass the recapture bill. To that extent I request all of you double your efforts. The next session of senate, which starts next month, is a short session and we should act NOW. otherwise nothing will happen until late next year.

    I really wish all the desi companies,who get people from India,and put them on bench to find a project ,be banned. They screwed H1B, and in turn all the deserving H1B candidates.

    here also they process so many H1s..... for various many people.... skills/no skills... keep them on bench.... inflate resumes....

    good response. we are all in this together and need to work together in order to get things done. IV is not just IV core but each and every member. each member should try to do something positive in order to help IV in whatever way theycan. - contributing money, help increase members, contact their local lawmakers and also contacting media. we need to raise awareness andevery small positive action done by an iv member helps in the overall scheme of things.

    I tend to disagrees with your comments, firstly please dont call this a stupid event, as a lot of young students strive to win this competition. In order to lead you have to follow, I have come across some smart ass Indians who love to talk and give directions, but they miss whole chunk of substance in their directions. (I don't mean to target you or disrespect any one else up here).

    Your commments on parents motivating their childeren to strive for success in their lives, their is nothing wrong in that, would you rather have them go smoke dope and jerk around to waste their time? I am indian and proud to be, , above all proud that my parents pushed me to excel and do better with the opportunities granted to me.

    However it is some desi companies who brought in the trend of lying and faking to get thie ways. But believe me , they dont get much further in their lives. I am glad strict restrictions are imposed on these companies, and the type of consultants they bring on board.

    Is it fair that the person doing Masters from this country be put in the same boat as a fresh of boat from India?

    I would further say, what is the difference between you and anti-immigrants in this matter ? You are saying that certain class of people should be kept out of the job market and you have your reasons. Since you are probably US educated, you want those who are non-US educated out of competition. Do not give me the BS reason that those with non-US education are the only ones that fake their resume. As far as faking the resume goes, or bragging goes, its up to the individual. It could be anyone, including Presidents that fake resumes or pad it with embellishments.

    The anti-immigrants are saying that they were born here so those who were not born here should be kept of out the job market to reduce competition (and spur wage inflation, which they would call fair wages, but its really wage inflation, the kind that drowned GM and Chrysler).

    Would it not behoove you to say that the decision of who should be hired and who shouldn't be hired must be deferred to the employers and not the Government or any other special interest ? As an employer, are they not the most capable party here to make that decision and evaluate their options ? Shouldn't people who create wealth (employers, businesses) have the prerogative to decide who they want to hire to help them create wealth ?

    The only thing that can help us predict Sep bulletin is how many visa # have been used so far from 2009 quota. Since USCIS will be rushing to use up all visa # the quantity can least give us an idea if dates will move few months or few years. USCIS should not have trouble with either since they have so many pre-adjudicated applications to take care of both scenario's. I am pretty optimistic (realistically confident) that there will be a forward movement.

    Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.

    Thank you WaldenPOd. I am a pharmacist and I am always extremely bz with my work and two kids. but my wife is actively participating in this effort. She has already posted flyers in Indian store and restaurant. I will ask her to post it in Chinese and other store.
    She is actively sending email to friends and relatives to join IV. Also, we are planing to visit universities around our area during this weekend and post flyers

    May be you're right. for the benefit of the others, can you provide more info, and any basis for your statements. This would be useful information to have for a lot of affected individuals. Is there any reference to INA or CFR that one could look up?

    the following are desi3933's comments:
    - sertasheep:Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
    - sertasheep: Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.
    - desi3933: 3/10 year ban applies to unlawful presence only and NOT for out of status. If I-94 date is passed, only then person starts accumulating unlawful presence. There is a BIG distinction between unlawful presence and out of status.

    Yes, there is a distinction between if the I-94 date has expired, or if it is valid
