    During the discussions on 1485 filing provisions we there were questions related to EB2, EB3 backlog numbers post 2007 july + Based on the recent information we got on pending numbers + our discussion on if EB2 will get current this year helps us understand how the last quarter will behave. This analysis is not official and is our own interpretation based on information we know. We do not wish to seek out specific information on visa bulletins. It has not been IV policy. VBkris has been involved with IV statistical analysis of data and has been in meetings with officials. He has come up with an explanation to this news and how it may play out for the last quarter. His interpretation makes sense to me and I have asked him to post on the forum.

    HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.

    The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.

    If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.

    If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.


    I see in Capital Ones' career website they only have the restriction
    "Capital One will not file non-immigrant visa petitions for alien workers."

    Need to tell him that
    1- EAD does not involve filing any petition on your behalf
    2- Making a rule to hire only Citizen and GC with no security reason is as discriminatory as not hiring based on race (DHS opinion not yours)
    3- You will not let something like this go quietly (try to put that point politely, but they may see it as a positive thing that you are determined and have the courage to stand up for what's right)

    can you please let everyone know when was your H1 approved? (that will help decide the pattern for passport delay due to PIMS..)

    My H1 extension and transfer to a new employer was approved around Feb 2007 and validity is between mar 2007 and feb 2010.

    So did you guys notice a pattern here ?

    Yes, I do agree that we should have some sense of personal responsibility and that is why the middle way is to rent out the house (probably at a bit lower price than your monthly mortgage) and pay the difference from your pocket - if you have to absolutely move out from the house. But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??

    Your posts are enlightening and breath of fresh air in an otherwise non-nonsensical forum discussion. Although people would want to, but talk about ethics and moral is not forbidden, not yet at least.
    The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?

    All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.

    In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.

    Punjabi77, good luck to you buddy. This will pass too, don't ruin everything for $20K. You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

    You have to be kidding! Here people are crying to get there EAD's extended and you think the Govt will give us citizenship???

    Please i suggest everyone to wake up and smell the coffee/chai.

    If you think giving us citizenship will be easy becoz it will prop up their vote bank think again coz it will never happen. Imagine the headlines which says recession time 10M americans out of job, foreign workers to get citizenship LMAO!

    Forget this ever happening in a recession time and not much of a chance in the boom time either, see how the Anti-Immi's will eat everyone up for this ridiculous suggestion, please remember we're nothing in the larger scheme of things for the decision making people, we need to understand our limitation and strengths and play by them, IV does a decent job of that.
    Do think rationally before coming up with ridiculous ideas like giving senators free pizza or asking for-direct citizenship. lol.

    No, the idea is; if you cry for gold you will atleast get silver. When the point is raised that people have been living here legally, paying taxes, SS, owning houses etc etc for 10 years!! what more is actually needed for citizenship?? The idea is to highlight that legal residents (many of them) have been here for ever!! 10 years is almost 15% of an average life span!! If only this thing is highlighted in some strong news papers. Isn't this protectionism at its worst. US is complaining about labor laws in China???? What the heck is this here??? You pay taxes and SS and medicare etc for 10 years and then you are asked to leave??????????? Isn't this slavery??? Either take of the requirement that workers on visas have to pay the required SS / medicare etc or assume responsibility for having taken their hard earned money and let them in as soon as possible into the society.

    If revenue from increased fee structure starting July 31 is the reason for making visas unavilable in July, I have a strong feeling that the visas may become current for all categories in the Aug Bulletin.

    This is not a NEWS or RUMOR making rounds anywhere. This is a mere speculation on my part. Let's hope for the best but DO NOT get your hopes unrealistically high.

    Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?

    Quite simply put EB3-ROW << EB2-I,C. So there is a faster chance of EB3-ROW going forward and being current before EB2-I becomes current. Therefore, with all other categories satisfied, it boils down to EB2-I/C and EB3-I/C. Thenceforth, as USCIS has indicated, the longest waiting PDs will be given the roll-over numbers, which is EB3-I.

    So what will be the flow? I guess the following

    EB1-> EB3-ROW (until current)
    EB2-ROW -> EB2-I/C

    Once Eb3-ROW becomes current

    EB2-ROW -> EB2-I/C
    EB3-ROW -> EB3-I/C
    EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)


    Please note, this is not going to be a quick fix for EB3-I. We are lowest on the totem pole, and barring legislative action, the only relief we can have is "earlier access" to numbers. Without a reversion of the complete horizontal spill over, older priority dates will continue to languish because EB2-I is going to remain sufficiently subscribed going forward.

    So I was having lunch at the Four Seasons with Lou Dobbs the other day, locked in disagreement over who cared more about working people, him or me.

    Him: CNN host, biggest and loudest gun in the battle for tougher immigration policies, leader of a nightly crusade to expose the misdeeds of those he views as elitist fools and scoundrels.

    Me: editorial writer whose views on immigration qualify, to Mr. Dobbs and many others on his side of the debate, as elitist, foolish and scoundrelly.

    Meeting at the Four Seasons was his idea, to continue a long, civil and inconclusive phone conversation about immigration. I got there early and waited at Mr. Dobbs?s banquette. I looked around the hushed room, full of dark suits and a wintry glow. Mr. Dobbs appeared and settled in, his drink, cranberry juice and seltzer, materializing at his right elbow.

    In the spirit of the occasion, I ordered strictly within our borders: lobster bisque, filet of bison and New York tap water. He had the Dover sole.

    Among people whose immigration views I admire, Mr. Dobbs has a reputation as a hopeless blowhard. I did not dwell on that at lunch. I was his guest, and I had seen what happens if you try to skewer him with insult or accusation. Mr. Dobbs is unencumbered by self-doubt. The granite fortress of his certitude is smooth and featureless, and whatever boulders you hurl at it will end up on your head. Besides, I was looking for something better than an argument. I wanted to convert him.

    An honest person must concede a lot when arguing immigration with Mr. Dobbs: Yes, the borders and ports are insecure, and poor countries like Mexico have done too little to solve their economic and migration problems. Yes, illegal immigration hurts some Americans, globalization causes many global problems and big corporations love to stick it to the little guy.

    My point to Mr. Dobbs was that the little-little guy ? the ?illegal alien? crossing our ?broken borders? ? was the wrong target. His overriding emphasis on solving globalization?s many ills by urgently sealing the borders strikes me as populism gone astray.

    First, it?s ineffective, because the country will never be ziplocked as tightly as he wants it to be. The price of trying is too high, and it ignores the millions who enter the country legally but overstay. Most shamefully, it does nothing to resolve the fates of the 12 million undocumented already here.

    Second, the obsession with enforcement dovetails with the agendas of some nasty people: the nativists for whom immigration is a simple case of brown and white, of preserving ?American? culture by keeping Latinos out.

    Third, it does too little to attack the evil corporate elites that are Mr. Dobbs?s sworn enemy. What makes illegal immigrants so delectable to big, bad business is their illegality ? their willingness to work cheap and under the table. So why not legalize and tax them? Assimilate the good guys, as this country has always done, and save law enforcement for the bad ones.

    The idea is to confront abusive corporate power with worker power. If day laborers end up in our suburbs, where the money and jobs are, then give them safe places to gather and help them work together to keep from driving wages and working conditions down. If companies take advantage of workers, empower the workers to fight back: as union members, legal residents, citizens.

    But that?s ?amnesty,? a Dobbsian expletive. It?s the opposite of the crackdowns endorsed by him and the hard-liners he praises, like the Minutemen.

    Mr. Dobbs listened graciously and budged not. He said he respected immigrants, even illegal ones, who he felt had gotten an unfair shake from their governments. He reminded me of his fondness for Cesar Chavez.

    Then he repeated his immigration credo. It went like this: the 1986 immigration law was an amnesty promoted by corporate interests waging war on the middle class. Thus the 2006 and 2007 reforms were also amnesty, pushed by the same self-serving plutocrats. So nothing they want is worth doing ? at least not until the border is sealed.

    That could be a long time. While we wait, I am going to keep trying to convince Mr. Dobbs that a comprehensive solution ? enforcement plus assimilation ? is the best expression of the populism he espouses.

    Mr. Dobbs admits that mass deportation would never work, although if you press him on what to do about the 12 million, he has no answer. He wants to hold that question ?in abeyance? until the border is sealed. I find that oddly passive for someone so convinced of the dangers from the aliens in our midst.

    I told him that, and he smiled. The lunch was over. I didn?t wrestle over the check because there was no check, just a goodbye from the staff. I got my coat and walked with Mr. Dobbs to his car. We shook hands and I thanked him for the discussion. He made me promise to continue it. I assured him I would.

No. 11032960), Charlie Oppenheim discussed scenarios for EB-2 movement in the coming months. In preparation of the May 2011 Visa Bulletin, DOS will consider the approximately 12,000 unused EB-1 numbers that will "spill-down" to EB-2, EB-2 demand and possible unused numbers, and will consult with USCIS on its processing potential. A quick look by DOS at this point indicates that there is the possibility for greater advancement of the India EB-2 category than had earlier been thought. Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

    We have plans of visiting Canada in November. My card had a data entry error because of which I have to apply for a replacement card. It can take 3 months for that.

    As I have no other proof of permanent residency (as I have to return the card with error), alternative is to get the I-551 stamp on the passport that is valid for 1 year. It works as a short term replacement of the acutal card.

    What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
    If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

    Multiple 485 and EAD filing

    Hi,

    My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.

    The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.

    Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).

    Any inputs or clarifications will be greatly appreciated.

    Yup. One should be ready for the consequences when they apply. Think carefully before you do something and do not make any errors in decisions.There are both advantages and disadvantages. A lawyer office that has done this in the past quoted a case to me. Another non-desi expensive lawyer who always gives accurate information and is not greedy told me that he would not advice multiple filing.

    Allowing to file on July 02 or July 03 depends on visa numbers available which in turn depends usage the preceding month. If all the numbers are used up (meaning Immigration Officers have requested visas from DOS in the process of approving pending I-485) they cannot allow anyone to file on July 02 or July 03 and so on.
    I guess currently race is on from USCIS to consume Visa numbers (40,000 or so) from DOS at unprecedented pace. That's why bulletin hasn't changed as yet. USCIS on its part is possibly trying to avoid flood of application at all cost, even if it requires working extra hours (and approving as many cases as possible) if it can save them later. DOS will NOT move the date back until the numbers are used up or near used up. I guess race is on....we will know on Monday. One way to know how true this is will be watching I-485 approvals from now till Monday. We are caught in the tug of war between USCIS and DOS. CIRCus isn't over yesterday....it is back in town again !!!

    Can they reject applications that received on 2 july ....logically if the application was received when the Visa date is current it should be accepted. Have to see the timing of the DOS bulletin as they may make it unavailble effective "Now" rather than effective from :" yesterday " if we didnt see any revision to VB today, people whose application received on Monday may be safe ..lets hope

    This is not a bad idea.

    If everyone think this is a good idea, then we need to do this with a little more planning than the flower campaign.

    We can route the pizzas to hospitals and orphanages, shelter for the homeless etc also.

    We can make them aware through this and then we can try to meet our Senators/Congress Representatives and explain. Over the years We have gathered enough numbers,information and knowledge about our problems , backlogs and Immigration System that we can talk about.
